The first step

Customs Clearance
Customs duty varies with the type of vehicle. Goods and Service Tax and occasionally LCT (Luxury Car tax) is applied. If there is no Vehicle Import Approval, $12000 Special duty is imposed.

Transaction value method
Transaction Value is the value on which the customs duty is based. This is the actual cost price of the vehicle proved by the bill of payment if the vehicle was bought with the sole purpose of importing to Australia. Some reduction may be allowed for the freight and insurance. If proof is not available, this method is not used.

Alternate method of Evaluation- Fall Back technique
If the transaction method cannot be applied, other methods are employed. A qualified person will assess the landed value. The Customs then makes necessary deductions to arrive at the Customs value.

Import of a car manufactured in Australia
You may bring it in without paying Customs duty provided you have owned and used the car overseas and there are no Australian taxes pending. However you have to pay the GST and LCT (where applicable).

Temporary Import
A tourist or temporary resident can import a car for a period of upto 12 months without paying customs duty. For this you need any one of the following:

  • A Carnet de Passages de Douanes issued by an organization of your country of residence which has an agreement with the Automobile Association of Australia. This gives all the details of the vehicle. It is like a passport and has details of the registration number, model, color, make, engine capacity, seating arrangement, value and owner’s name. A person who brings a car using the Carnet needs to provide evidence of his identity (EOI).
  • A cash or bank security for the payment at the Customs which include the Duty, GST and LCT (if applicable). This comes under Section 162 of the Customs act. It is applicable to cars which are over 15 years of age or vehicles meeting the design requirements. Your vehicle will be released only with the permission of the Customs and Department of Transport and when the Regional Service Requirements are fulfilled.

A point to note
When exported, all the items which were in the car at the time of import should be present in the car at the time of export.

Disposal of car
Only after satisfaction of the various requirements and with special permission only can you dispose of your car or even lend it. It therefore cannot also be mortgaged or sold or exchanged.

Quarantine
All imported vehicles are inspected thoroughly for poisonous weeds, insects and illnesses. Steam cleaning is done.

Insurance
This is usually in the form of third party insurance. You should ideally select a good insurance plan for your vehicle and yourself.

The Motor Vehicles Standards Act of 1989
An imported vehicle must comply with the safety and emissions standards of Australia. If not, you must agree to get it modified at a prescribed centre.

Safety standards
The requirements are working headlights, working tail lights including the indicator light for the brake and turning light for changing direction, windscreen wipers in good condition, effective brakes, seat belts (if fitted) and child restraints (if fitted). The tires should be good with minimum tread depth. There should be no oil leaks.

New regulations state that the air conditioning CFC gas ( R12 ) is banned in Australia. HCFC gas (R134A) may be imported under a license. A certificate from a refrigeration or air conditioning company stating on their letterhead that CFC is not found in the car would prove useful.

Vehicle Registration
The Customs has no authority over the registration. You have to check with the Motor Vehicle Registration authorities of your state of residence to know the requirements before transporting the vehicle. The papers necessary are

In the case of individuals, this regime applies to goods valued at USD 10,000 CIF or more. BIVAC INTERNATIONAL, a subsidiary of Bureau Veritas, France, is the pre-shipment inspection company authorized by the Angolan Government to carry out the inspections. The cost of inspections is paid by the Angolan Government. It is important to consult BIVAC and/or the legislation, as PSI also applies to some other goods, irrespective of value. The importer initiates the PSI process in Angola, before arranging for shipment, by submitting a Proforma Invoice of the goods to be imported to the Ministry of Commerce for stamping and registration.

Exporters to Angola must present all documentation required by BIVAC, to enable them to issue a Clean Report of Findings (CRFs), which must be submitted together with other Customs documentation in order for the goods to be cleared.

The use of a Despachante Oficial (Custom Broker) is compulsory for all imports exceeding USD 1000 CIF in value.

Importers in Angola, or their Brokers, must apply to Customs, prior to the arrival of the goods, for an Exporter Code (A code designated to suppliers to Angola). This code is used to complete the Customs Declaration. The entry processing system will reject declarations which do not contain this data.

Normal Clearance Procedure
Foreign made vehicles imported into France (i.e. non-European Community), whether new or used, attract Customs duties, depending on the origin of the vehicles, and, all vehicles imported into the country, irrespective of their origin, are liable to value added tax (VAT) at the uniform applicable rate of 19.6%.
When the vehicle is imported directly into France from Canada or the US, Customs duties and VAT will be collected at the port of entry by the French Customs & Excise Service.

When the vehicle is shipped to France via another Member State of the European Union:
- Customs duties (levied at a uniform rate throughout the European Community) will have been paid at the port of entry into that State: only VAT will, therefore, have to be paid in France. It will not be collected by Customs but by the French Internal Revenue Service, the local tax collector (“receveur des impôts” );
- the vehicle will have moved to France from the port of entry in-bond (under the external Community transit procedure, i.e. under cover of a “T1″ declaration), in which case, both Customs duties and VAT will have to be paid when the vehicle is cleared with the French Customs & Excise Service.

Instructions to importer Vehicles:

- The vehicle shall be in conformity with the Kingdom’s standards, and its steering system shall not undergo modification.
- There are no damages on the vehicle body. If the damage occurs at the arrival port, a certificate from the competent authorities is required to be submitted accordingly.
- The vehicles that have been subject to accidents such as drowning, fire, collision, rollover, etc are not allowed to be imported.
- The vehicles used as taxicab or by police are not allowed to be imported.
- The importer’s residence authorization (Iqama) shall be valid, if the importer is not a citizen of any of the GCC states.
- It shall not be permissible to import more than one vehicle per year, if the importer does not have a commercial registration legalizing business activity in vehicle sale and import.
Documents required for assessment of vehicle customs duty First: Vehicles imported from the GCC States:
- Export form issued by the competent agency (Traffic Department) in the country where the vehicle registered, or a quittance document along with a valid vehicle ownership document issued by the competent authorities in the exporting country of the vehicle, if it is secondhand.
- Customs declaration of the customs administration in the country of exportation. 3. If the vehicle is not in the name of the importer, it is required to submit a legal power of attorney issued not more than one year ago that gives the agent the right to dispose of the vehicle and finalize payment of customs duty due on it.

For clearance purposes among the GCC States: 1) If the vehicle is imported through any of the GCC states’ ports after January 1, 2003 and its final destination is Saudi Arabia, the following document shall be submitted:
The original copy of the import declaration of the first entry port in the exporting country or a legalized copy of it sealed with the clearance seal of the exporting country including all required information and the amount of the customs duty subject to the clearance. 2) If the vehicle is imported to any of the GCC states after January 1, 2003 and the importer bought it from any of the GCC states’ markets and he wants to transport it to the Kingdom, the following documents shall be submitted:
- The original copy of the statistical customs declaration sealed with the clearance seal of the exporting country including all required information and the amount of the customs duty subject to the clearance.
- The original copy of the import declaration of the first entry port in the exporting country or an attested copy of it. Second:

- Submit a legal document indicating the importer’s ownership of the vehicle. This document shall be attested by the Saudi commercial attache or his duly authorized representative in the country where the vehicle purchased, or by the chamber of commerce in the exporting country.
- Export declaration of the customs administration in the country from which the vehicle exported. The invoice and the certificate of origin shall be attached to the export declaration.

- A document issued by the competent security authorities in the shipping country indicating that the vehicle is not wanted. Secondhand vehicle appraisal mechanism:
1) The value for customs purposes is calculated according to the price lists issued by the manufacturers. Vehicles manufactured for special purposes and antique cars are excluded.
2) The depreciation rate is deducted according to the model year, and the value of freight and insurance is added.
3) The method of deduction is on monthly basis according to the age of the vehicle.
4) The importation date shall be taken into account to determine the age of the vehicle in years and months. The model year starts at the beginning of January and expires at the end of December.
5) The vehicle imported during the first six months of the model year is considered new and there is no deduction.
6) For the vehicle imported during the last six months of the model year there will be a deduction at a rate of 2% per month or parts of it.
7) For the vehicle imported during the second year until the fifth year of the model year there will be a deduction at a rate of 1% per month or parts of it.
8)The maximum deduction rate is 60% of the price of the vehicle imported after more than five years from the beginning of the model year.
9) The customs duty rate is (5% for motor cars, 12% for trucks).

In an effort to facilitate the procedures for the importers, whether individuals or judicial persons, the Saudi Customs allows the importers to complete by themselves the customs formalities of their imported items whether commercial consignments or personal effects. Also, they can duly authorize other persons but not the customs brokers to act on their behalf.
